Terms of Service

Welcome to Fitnix. These Terms of Service (“Terms”) govern your access to and use of the Fitnix mobile application, website (getfitnix.app), and any related services (collectively, the “Service”) provided by Fitnix (“we,” “our,” or “us”). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use Fitnix. If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian’s permission to use the Service and to agree to these Terms on your behalf. The Service is not intended for children under 13, and we do not knowingly collect data from them.

2. Description of the Service

Fitnix provides AI-generated personalized workout plans, exercise tracking, progress analytics, and related fitness-coaching features. Workout plans are generated based on the goals, equipment, and fitness information you provide during onboarding. The Service is available as a free tier and as a paid “Pro” subscription with additional features.

3. Account Registration

To use most features you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your login credentials and for any activity that occurs under your account. Notify us immediately at support@getfitnix.app if you suspect unauthorized access.

4. Subscriptions, Free Trials, and Billing

Fitnix offers monthly and annual auto-renewing subscriptions. Purchases are processed by Apple (App Store) or Google (Google Play), subject to their payment terms. You can manage or cancel your subscription at any time through your Apple ID or Google account settings.

• Free trial: New subscribers may be eligible for a free trial. At the end of the trial, the subscription auto-renews at the then-current price unless cancelled at least 24 hours before the trial ends.
• Auto-renewal: Subscriptions auto-renew for the same period (monthly or annually) until cancelled. Your Apple ID or Google account will be charged for renewal within 24 hours prior to the end of the current period.
• Cancellation: Cancel at any time in Settings → Apple ID → Subscriptions (iOS) or Google Play → Subscriptions (Android). Access to Pro features remains available until the end of the paid period.
• Refunds: Refund requests are handled by Apple or Google according to their policies. Fitnix does not process refunds directly for app-store purchases.

5. Health and Safety Disclaimer

Fitnix is a fitness information service, not a medical or healthcare provider. The workout plans, suggestions, and content provided by the Service are for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified physician before beginning any new exercise program, especially if you have a pre-existing medical condition, are pregnant, or are recovering from an injury.

You use the Service at your own risk. By using Fitnix, you acknowledge that exercise carries inherent risks, including risk of injury, and you assume all such risks. Stop exercising and seek medical attention immediately if you experience pain, dizziness, or any adverse symptoms.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Reverse-engineer, decompile, or attempt to extract source code, except as permitted by applicable law;
• Use bots, scrapers, or automated tools to access the Service;
• Interfere with, disrupt, or overload our servers or the networks connected to the Service;
• Impersonate another person or misrepresent your affiliation with any entity;
• Attempt to gain unauthorized access to any part of the Service or to any account other than your own.

7. Your Content

You retain ownership of the profile information, workout logs, body measurements, and other data you submit to the Service (“User Content”). You grant Fitnix a worldwide, non-exclusive, royalty-free license to host, store, process, and display your User Content solely to operate and improve the Service. You can delete your User Content at any time by deleting your account in-app (Profile → Delete Account).

8. Intellectual Property

The Service, including its name, logo, design, software, and content (other than User Content), is owned by Fitnix and protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes only.

9. Third-Party Services

The Service relies on third-party providers, including but not limited to Apple, Google, Supabase (authentication and data storage), RevenueCat (subscription management), and AI providers for workout generation. Your use of the Service is also subject to the terms of those providers where applicable.

10. Termination

You may stop using the Service at any time and delete your account directly from the app. We may suspend or terminate your access if you violate these Terms, misuse the Service, or for any lawful reason at our sole discretion. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will survive.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available”without warranties of any kind, whether express, implied, statutory, or otherwise. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your specific fitness goals. Results from following workout plans vary from person to person.

12. Limitation of Liability

To the maximum extent permitted by law, Fitnix and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from your use of or inability to use the Service. Our aggregate liability for any claim arising from or related to the Service shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Fitnix from any claims, damages, or expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the Service, or your violation of any rights of a third party.

14. Changes to the Terms

We may modify these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where required, notify you in-app or by email. Continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of your country of residence unless otherwise required by mandatory local law. Any disputes will be resolved in the courts of competent jurisdiction.
